Terms and conditions

1. Scope

These terms and conditions apply to all quotes, jobs and deliveries by Elevate Immo Visuals (company number BE 1042.313.597), “we”, to professional clients such as estate agents and property developers, “the client”. Deviations only apply if we confirm them in writing. The client's own terms do not apply.

2. Quotes and prices

• Our quotes are valid for 30 days. All prices are in euros and exclude VAT.
• Travel is charged at €0.44 per kilometre, return trip from Koersel (Beringen).
• Express delivery within 24 hours costs €50 extra (excl. VAT), where the schedule allows.
• Additional costs for permissions in restricted airspace are communicated in advance.

3. Jobs and scheduling

A job is final as soon as the client confirms the quote or date, including by email. The client provides access to the property at the agreed time, a property prepared according to our checklist and the consent of the owner and occupants for the shoot, including indoors. The client informs occupants and, where needed, neighbours.

4. Airspace, permissions and safety

Before every flight we check the airspace and request the necessary permissions. If a flight is not legally permitted or a permission is refused, we look for an alternative with the client or cancel that part of the job at no cost. The pilot always decides whether a flight can be carried out safely.

5. Weather

In rain, strong wind, poor visibility or other conditions that prevent a safe flight or a good result, we move the shoot to a new date agreed together, at no extra cost. This does not count as a cancellation.

6. Cancellation by the client

• Up to 48 hours before the shoot: free of charge.
• Less than 48 hours before the shoot: 50% of the job price.
• No access to the property or shoot impossible on site because of the client: 100% of the price, plus travel costs.

7. Delivery

We deliver the edited visuals within 48 hours of the shoot (24 hours with express delivery) by download link. Weekends and public holidays are not counted. Delivery times are a best-efforts obligation; a limited delay does not entitle the client to compensation or termination. The client keeps the delivered files; we keep them for at least 30 days.

8. Payment

Invoices are payable within 14 days of the invoice date. In case of late payment, late-payment interest is due automatically and without notice under the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, together with a fixed compensation of €40 per invoice, without prejudice to our right to higher compensation on proof. Any objection to an invoice must be made in writing within 8 days of receipt.

9. Usage rights

• We retain the copyright in the visuals.
• After full payment the client receives a non-exclusive usage right, unlimited in time, to use the visuals to promote, sell or let the property concerned, on all channels (property portals, website, social media, print).
• Any other use, resale or licensing to third parties requires our prior written consent. The owner of the property may use the visuals for the same sale or letting.
• We may use the visuals in our portfolio and on our channels unless the client tells us in writing that they would rather we did not.

10. Complaints

Complaints about the delivered visuals must be made in writing, with reasons, within 8 days of delivery. If the complaint is justified, we re-edit the visuals or schedule a new shoot. A complaint does not suspend the obligation to pay.

11. Liability

We are insured for our activities. Our liability is limited to damage that results directly from an error on our part and, in any event, to the invoiced amount of the job concerned, except in case of intent or gross negligence. We are not liable for indirect damage, such as loss of profit or a delayed sale. Any damage to the property during a shoot must be reported immediately on site.

12. Force majeure

In case of force majeure, such as illness, equipment failure, decisions by authorities or aviation authorities or extreme weather, we may postpone the job or, if postponement is not possible, cancel it at no cost.

13. Privacy

We process personal data in line with our privacy policy.

14. Governing law

These terms and all jobs are governed by Belgian law. Disputes fall under the jurisdiction of the courts of the judicial district of Limburg.
